These Terms and Conditions (“Terms”) govern your access to and use of the CARS360 platform available at https://cars360.co.ke, including all related pages, features, tools, services and partner offerings provided through the platform.
CARS360 is an online marketplace that helps users browse cars for sale, compare used cars for sale, access vehicle-related services, request car import support, explore financing and insurance options, and connect with sellers, dealers and service partners.
By accessing or using CARS360, creating an account, browsing vehicle listings, submitting an enquiry, listing a vehicle, requesting a service or interacting with any part of the platform, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the platform.
About CARS360 Terms
These Terms apply to all users of CARS360, including visitors, buyers, sellers, dealers, service providers, partners and registered account holders.
They govern the use of CARS360 services related to vehicle listings, auto sales, car imports, car valuation, vehicle financing, car insurance, car tracking, spare parts and other automotive services that may be made available on the platform from time to time.

Using CARS360
CARS360 allows users to browse, compare and enquire about vehicle listings. You agree to use the platform only for lawful purposes and in a manner that does not infringe the rights of CARS360, other users, sellers, dealers, partners or third parties.
CARS360 reserves the right to suspend or restrict access to any user who violates these Terms or uses the platform in a manner that may harm other users, partners or the integrity of the marketplace.
You must not use CARS360 to:
- Post false, misleading, fraudulent or inaccurate information.
- Misrepresent vehicle ownership, condition, mileage, price or availability.
- Impersonate another person, business, dealer or representative.
- Interfere with the security, performance or availability of the platform.
- Upload harmful code, malware, spam or unauthorised advertising.
- Use data from CARS360 for scraping, resale or unauthorised commercial purposes.
Account Registration and User Responsibilities
Some CARS360 features may require you to create an account or provide contact information. You agree to provide accurate, current and complete information during registration, enquiry submission or service requests.
You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account.
You agree to notify CARS360 immediately if you suspect unauthorized access to your account or misuse of your information.
CARS360 may suspend, restrict or terminate your account if we believe that:
- Your information is inaccurate, incomplete or misleading.
- Your account has been used for fraudulent or unlawful activity.
- You have breached these Terms.
- Your activity may expose CARS360, users or partners to risk.
Vehicle Listings, Auto Sales and Seller Responsibility
CARS360 provides a platform for vehicle discovery, enquiries and marketplace connections. Unless expressly stated otherwise, CARS360 is not the seller, buyer, owner or legal representative of vehicles listed on the platform.
Vehicle sellers, dealers and listing owners are responsible for ensuring that all listing information is accurate and lawful, including:
- Vehicle make, model, year and variant.
- Mileage, condition and ownership status.
- Price, availability and location.
- Import status, duty status or registration details.
- Images, descriptions and specifications.
Users interested in selling cars or listing vehicles on CARS360 must ensure they have the legal authority to sell or advertise the vehicle.
Buyers are responsible for carrying out their own checks before purchase, including physical inspection, ownership verification, logbook confirmation, tax or duty checks, mechanical inspection and any other due diligence required before making payment or entering into a transaction.
Car Import Nairobi Services
CARS360 may provide information, lead generation or partner support for car import services, including assistance with sourcing, import enquiries, partner introductions, documentation guidance, shipping coordination or vehicle clearance support. Unless specifically stated in writing, CARS360 does not guarantee:
- Vehicle availability from overseas suppliers.
- Final landed cost or exchange rate stability.
- Import duty, tax or clearance outcomes.
- Shipping timelines.
- Mechanical condition beyond provided inspection reports.
- Third-party supplier or clearing agent performance.
Any import-related transaction may be subject to separate agreements, invoices, supplier terms, shipping terms, government regulations and customs requirements.
Users are encouraged to review all import documentation carefully before making payment or committing to a vehicle import process.
Car Financing, Loans and Insurance Terms
CARS360 may connect users with third-party partners offering car financing, vehicle financing, car loans, car insurance and comprehensive car insurance services.
These services are provided by independent banks, lenders, insurers, brokers or financial partners and may be subject to their own eligibility criteria, approval processes, documentation requirements, fees, rates, terms and conditions. CARS360 does not guarantee:
- Approval for financing or insurance.
- Specific interest rates, premiums or repayment terms.
- Insurance cover acceptance.
- Claim approval.
- Final partner decisions.
Any financing, loan or insurance agreement is entered into directly between you and the relevant third-party provider.
You are responsible for reviewing and understanding all terms before accepting any financing, loan, insurance or related service offer.
Car Valuation, Tracking and Related Services
CARS360 may offer or facilitate services related to car valuation, vehicle tracking, GPS tracking, ownership support, parts, accessories and other automotive solutions.
Valuations provided through the platform may be based on information such as vehicle age, mileage, condition, market demand, comparable listings, location and other available data.
Valuation estimates are for guidance only and may not represent a guaranteed sale price, insurance value, financing value or trade-in value.
Vehicle tracking, GPS tracking and related services may be provided by third-party providers and may be subject to separate installation, subscription, maintenance or service terms.
Payments, Billing and Refunds
Payments made through or in connection with CARS360 may relate to listings, services, imports, parts, financing support, insurance, subscriptions, promotional services or other platform-related offerings.
Billing, cancellation and refund matters are governed by the applicable service terms, invoice terms, partner terms and CARS360’s Billing & Refund Policy where relevant.
Users should confirm payment details, service scope, refund conditions and cancellation terms before making payment.
CARS360 will not be responsible for payments made outside approved CARS360 channels or directly to third parties unless such payment arrangement has been expressly authorised in writing.
Third-Party Partners and External Services
CARS360 may work with third-party sellers, dealers, importers, insurers, finance providers, tracking providers, parts suppliers, inspection partners, payment processors and technology service providers.
While we aim to work with reputable partners, CARS360 does not control all third-party services and is not responsible for their independent actions, omissions, representations, products, approvals, delays or service outcomes.

Platform Content and Intellectual Property
All content on CARS360, including text, graphics, logos, icons, images, layouts, software, design elements, data structures and brand assets, is owned by or licensed to CARS360 unless otherwise stated.
You may use the platform for personal or legitimate business purposes related to vehicle browsing, enquiries, listings and services.
You may not copy, reproduce, distribute, modify, scrape, republish or commercially exploit CARS360 content without prior written permission.
Vehicle images, descriptions or listing content submitted by sellers may be used by CARS360 for listing display, marketing, search optimisation, platform promotion and related marketplace functions.
Privacy and Data Protection
Your use of CARS360 is also governed by our Privacy Policy and Cookie Policy.
By using the platform, you acknowledge that CARS360 may collect, use and process personal information in accordance with those policies, including information submitted when browsing listings, requesting valuations, applying for financing, enquiring about insurance or contacting sellers and partners.

Limitation of Liability and Disclaimers
CARS360 aims to provide accurate, useful and up-to-date information. However, we do not guarantee that all listings, prices, descriptions, images, valuations, availability, partner offers or service information will always be accurate, complete, current or error-free.
The platform is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, CARS360 will not be liable for:
- Losses arising from reliance on vehicle listings or third-party information.
- Transactions between buyers, sellers, dealers or partners.
- Vehicle defects, ownership disputes or misrepresentation by sellers.
- Financing, insurance, import, tracking or service provider decisions.
- Loss of data, profits, revenue, opportunity or business interruption.
- Technical errors, downtime, delays or unauthorised platform access.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold CARS360, its officers, employees, agents, partners and affiliates harmless from any claims, losses, damages, liabilities, costs or expenses arising from:
- Your use or misuse of the platform.
- Your breach of these Terms.
- False, inaccurate or misleading information you provide.
- Listings, enquiries, transactions or communications you submit.
- Violation of applicable laws or third-party rights.
Suspension or Termination of Access
CARS360 may suspend, restrict or terminate your access to the platform at any time if we believe you have breached these Terms, engaged in fraudulent activity, misused the platform, violated applicable laws or created risk for CARS360, users or partners.
Termination does not affect any rights, obligations or liabilities that arose before termination.
Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Kenya, unless otherwise required by applicable law.
Where a dispute arises, users are encouraged to contact CARS360 first so that the matter can be reviewed and resolved amicably where possible.
If the dispute cannot be resolved informally, it may be referred to the appropriate courts or dispute resolution mechanisms in Kenya.
